Lululemon Sues Costco Over Alleged Counterfeit Sales

 

In July 2025, Lululemon filed a lawsuit against Costco in the U.S. District Court for the Central District of California, alleging that Costco’s private label brand, Kirkland, is manufacturing and selling hoodies, jackets, and pants that closely resemble some of Lululemon’s popular products. The suit claims this causes consumer confusion, leading some to mistakenly believe that Kirkland products are made by the authentic supplier of the “original” products.

Lululemon is asking the court to order Costco to pay damages for lost profits resulting from the alleged infringement, to permanently stop manufacturing or selling any counterfeit items, and to remove all advertisements or online posts displaying the infringing products.

In a statement, a Lululemon spokesperson said: “As an innovation-led company that invests significantly in the research, development, and design of our products, we take the responsibility of protecting and enforcing our intellectual property rights very seriously and pursue the appropriate legal action when necessary.”
