How Foreign Nationals Can Apply for Permanent Residence in Taiwan
Foreign nationals applying for permanent residence in Taiwan may do so under the following categories:
Category 1 (Legal Basis: Immigration Act, Article 25)
An alien who has legally and continuously resided in the State for five (5) consecutive years, and who has resided in the State for one hundred and eighty-three (183) days or more each year, and who meets the following requirements:
1. Is eighteen (18) years of age or older.
2. Has good conduct and no criminal record, as evidenced by a Police Criminal Record Certificate.
3. Has sufficient property, skills, or talents to support living expenses. This requirement does not apply to an applicant whose spouse is a national with household registration in the Taiwan Area.
4. Has met the national interests of the State.
Category 2 (Legal Basis: Immigration Act, Article 25)
An alien spouse and/or children of a national with household registration in the Taiwan Area who have legally resided in the State for ten (10) years, during which they have actually resided in the State for one hundred and eighty-three (183) days or more per year for at least five (5) years, and who meet the following requirements:
1. Is eighteen (18) years of age or older.
2. Has good conduct and no criminal record, as evidenced by a Police Criminal Record Certificate.
3. Has sufficient property, skills, or talents to support living expenses. This requirement does not apply to an applicant whose spouse is a national with household registration in the Taiwan Area.
4. Has met the national interests of the State.
Category 3 (Legal Basis: Immigration Act, Article 25)
An alien who meets one of the following conditions:
1. Has made distinguished contributions to the State.
2. Is a senior professional needed by the State.
3.Has participated in internationally recognized competitions, contests, or evaluations in the fields of culture, art, technology, sports, or industry, and has won first prize.
Category 4 (Legal Basis: Immigration Act, Article 25; Regulations Governing Visiting, Residency, and Permanent Residency of Aliens, Article 16)
A foreign national who is an investor in the Republic of China (ROC) and meets one of the following criteria:
1. Has invested at least NTD 15 million in a profit-seeking enterprise and has created employment opportunities for five (5) or more ROC nationals for at least three (3) years.
2. Has invested at least NTD 30 million in bonds issued by the central government for a period of at least three (3) years.
Category 5 (Legal Basis: Immigration Act, Article 25)
The spouse, minor children under the age of eighteen (18), or children aged eighteen (18) or over who are unable to support themselves due to physical or mental disability of applicants under Category 3 or Category 4.
Category 6 (Legal Basis: Act for the Recruitment and Employment of Foreign Professionals, Article 18)
Foreign Special Professionals who have obtained an Employment Gold Card and have legally and continuously resided in Taiwan for three (3) years, with an average residence of one hundred and eighty-three (183) days or more per year, and who meet the following requirements:
1. Is eighteen (18) years of age or older.
2. Has good conduct and no criminal record, as evidenced by a Police Criminal Record Certificate.
3. Has sufficient property, skills, or talents to support living expenses.
4. Has met the national interests of the State.
Category 7 (Legal Basis: Act for the Recruitment and Employment of Foreign Professionals, Article 19)
After a Foreign Special Professional has been granted permanent residence by the National Immigration Agency, the following family members may apply if they have legally and continuously resided in Taiwan for three (3) years, with an average residence of one hundred and eighty-three (183) days or more per year, and meet the following requirements:
- The spouse
- Minor children
- Adult children who are unable to live independently due to physical or mental disabilities
Requirements:
1. Has no record of misconduct and no criminal record, as evidenced by a Police Criminal Record Certificate.
2.Has met the national interests of the State.
